Terms and Conditions of Use of BerryLabs

Welcome to BerryLabs! These terms and conditions govern your use of all websites and applications associated with BerryLabs ("BerryLabs"). By accessing, registering, downloading, or using our platform, you acknowledge that you have read, understood, and agree to comply with these terms and conditions and our privacy policy. If you do not agree to these terms, please do not use our services.
1. Consent to Terms
By accessing and using berrylabs.io and app.berrylabs.io (collectively referred to as "Sites"), you agree to be bound by these terms and conditions. BerryLabs reserves the right to update, modify, or remove parts of these terms and conditions at any time without prior notice. Changes will take effect immediately upon publication on the Sites. You are encouraged to review these terms and conditions periodically.
2. Types of Services We Offer
BerryLabs provides services to two types of users:
1. Organizations: For example, banking companies, insurance companies, or companies that require virtual agents services.
2. Participants: For example, customers who are taking identity verification services organized by Organizations.
BerryLabs reserves the right to deny access to our services if there is a violation of these terms.
3. Use of the Platform by Organizations
Organizations must not post or disseminate content that contains:
Hatred towards certain ethnicities, religions, races, or groups
Pornographic material
False or hoax information
Content that violates laws in Indonesia
BerryLabs reserves the right to terminate services without compensation if an Organization violates these terms. Each Organization must have at least one Administrator responsible for managing content and services.
4. User Account Terms
Organizations and Participants must be registered as active users to use BerryLabs services.
All data requested by BerryLabs must be filled in with verifiable authentic identities.
Organization Administrators and Participants are responsible for maintaining the confidentiality of their data and passwords.
Each user is responsible for the security of the devices used to access the services.
BerryLabs will never ask for passwords or token codes from users.
BerryLabs is not responsible for losses resulting from user negligence in maintaining account security.
BerryLabs reserves the right to block or delete accounts at our discretion.
5. Fees and Subscriptions
Organizations must purchase a subscription package that includes a quota or token to use BerryLabs services.
Participants do not need a subscription to take verification or assessment services from Organizations.
Prices and types of subscription packages may change at any time. We do not offer price protection or refunds for promotional offers.
There are no refunds if a subscription is canceled prematurely.
6. Use and Copyright of Virtual Agent Templates
BerryLabs provides virtual agent templates to help organizations conduct virtual agent services efficiently. Template types include:
Free: Templates that can be used at no cost.
Premium: Paid templates that can be purchased by Organizations.
Organizations can purchase and use modules provided by BerryLabs for verification or assessment purposes. Premium templates that have been purchased can be modified, duplicated, and used by the respective Organization. Templates created by Organizations are the property of the Organization. Templates created by BerryLabs are the property of BerryLabs and may not be used outside our platform.
7. Intellectual Property
All content on this Site, including text, graphics, logos, icons, and software, is the property of BerryLabs or its licensors and is protected by copyright laws, trademarks, and other intellectual property rights. Users are not permitted to reproduce, distribute, or use this content without our written permission.
8. Disclaimer of Warranties
This Site is provided "as is" without any warranties, whether express or implied. BerryLabs does not warrant that the services will be error-free, virus-free, or contain other harmful components. Use of this Site is at the user's own risk.
9. Limitation of Liability
To the extent permitted by law, BerryLabs is not liable for any losses arising from the use or inability to use this Site, including direct, indirect, incidental, consequential, or punitive damages.
10. Indemnification
Users agree to defend, indemnify, and hold harmless BerryLabs and our affiliates, directors, officers, employees, and agents from any claims, damages, costs, and expenses, including reasonable attorney fees, arising from the use of this Site or violation of these terms and conditions.
11. Governing Law
These terms and conditions are governed by the laws of the Republic of Indonesia, without regard to conflict of law principles. Disputes arising from these terms and conditions will be resolved in a court of competent jurisdiction in the Republic of Indonesia.
12. Termination
We reserve the right to suspend or terminate user access to this Site without prior notice if the user violates these terms and conditions or engages in activities harmful to the Site or other users.
13. Entire Agreement
These terms and conditions constitute the entire agreement between you and BerryLabs regarding the use of this Site and supersede all prior agreements and understandings.
